On unincorporated land the Lyon County Zoning Administrator must approve the plans before any permit issues for new construction or a change of use, and the county lists a building permit among its online permits. A permit lapses if work has not started within 180 days. Emporia and the other cities handle permits inside their own limits.

- The Lyon County Board of County Commissioners approved the current Lyon County Zoning Regulations (LC-Z) by Resolution 02-21, after the Planning and Appeals Board recommended them on November 9, 2020.
- Minimum acreage for a home
- The county zoning office's published answer to how many acres a home needs is a 5-acre minimum, which could change if the land is platted.
- Agricultural determination
- Under the county regulations, parcels of 40 acres or more are considered agricultural without a separate determination. Below 40 acres, the Zoning Administrator decides from the facts and issues a letter; the test is whether the farm use is substantial and not a residential use in disguise.
- Floodplain
- Lyon County states that virtually any man-made change in a flood area needs a permit, and that a house in a floodway area also requires a permit from the Kansas Department of Agriculture Division of Water Resources and possibly the Corps of Engineers.
